President William Ruto has called on Kenyan families to stop cutting up farms into ever-smaller plots and to consider land consolidation, with homes built in organised settlements and larger tracts kept for crops. He made the remarks at a church service in Kakamega on Sunday, October 11, 2026. No bill, minimum plot size or implementation timeline has been announced.

The proposal is a policy signal for now, not a new law. But the rules that already govern splitting farmland are tighter than many landowners assume, and they apply today.

What did Ruto say about family land?

According to reports by Kenyans.co.ke and Kenya Today, the President linked the push to population growth pressing on farmland. His argument was that repeated subdivision leaves households with too little land to grow food, coffee or vegetables for income.

He urged parents to consider settlement arrangements, so that farms are not divided each time a child needs a place to build a home. Both reports say the idea fits the government’s affordable housing programme, which uses public land and parcels transferred from state agencies for planned residential development.

Key facts at a glance

  • When and where: Sunday, October 11, 2026, at a church service in Kakamega.
  • The ask: consolidate land, build homes in organised settlements, keep larger plots for food and cash crops.
  • Legal route cited: the Land Consolidation Act (Cap. 283), which covers consolidating scattered parcels, recording interests, surveying and registering ownership.
  • Objection window: 60 days for affected parties to challenge the register under that process, as reported.
  • Not yet announced: a minimum plot size, a draft bill or a rollout date.

Can you already subdivide agricultural land in Kenya?

Yes, but not freely. Under the Land Control Act, dividing agricultural land into two or more parcels with separate titles is a “controlled transaction” (section 6). It is void unless the local land control board consents. Sale, lease, transfer and partition of such land are covered by the same rule.

When deciding, the board must weigh the effect on economic development and good husbandry (section 9). Consent should generally be refused where a division is likely to reduce the land’s productivity. The Act defines agricultural land as land outside municipalities, townships and markets, unless the Cabinet Secretary has gazetted an urban area as agricultural.

Two practical points follow from the text of the Act, as published on Kenya Law:

  • An application for consent must be made within six months of the agreement, though the High Court can extend that period for sufficient reason.
  • Passing land on by will or intestacy is excluded from the consent rule unless it results in division into separate titles.

That last point matters for families. Inheritance itself does not need board consent, but splitting an estate into separately titled plots does.

What would land consolidation change?

Consolidation works in the opposite direction from subdivision. Instead of dividing a holding, it brings scattered or fragmented parcels together so they can be farmed as workable units, with ownership recorded in a register. Officials have not said whether the new push would be voluntary, county-led or tied to incentives, and the reports do not say.

Readers weighing a purchase or a family succession plan should not wait for a policy that does not yet exist. Checking the status of a title is a sensible first step; see our earlier explainer on what residents can do when title deeds are rejected.

Why does farm size matter?

Smaller plots can still pay if the crop is high value. Coffee counties, for instance, earned about Sh17 billion in a recent season on mostly smallholder farms. The government’s argument is about viability: a plot too small to feed a household and yield a surplus pushes families toward off-farm work or further splitting. How large is too small is the question the announcement leaves open.

Government support programmes are also tied to farm output. Our report on a Sh12.4 billion boost for 625,000 farmers shows how farmer numbers, not plot sizes, are the usual yardstick.

Frequently asked questions

Has Kenya banned dividing family land?

No. As of October 2026 there is no ban. Division of agricultural land into separate titles already needs land control board consent, and no new law or minimum plot size has been announced.

Does inheriting land need land control board consent?

Transmission by will or intestacy is excluded from the consent rule, unless it results in the land being divided into separate titles.

What is the Land Consolidation Act?

It is the law (Cap. 283) that provides a framework for consolidating scattered parcels, recording land rights, surveying and registering ownership in designated areas, with an objection period for affected parties.

Is there a minimum plot size for farmland in Kenya?

No minimum size was announced alongside Ruto’s remarks. Boards decide case by case, weighing productivity and good husbandry.

Where can I check the rules?

The Land Control Act is published on Kenya Law. For a specific parcel, speak to your county land registry or an advocate. This article is general information, not legal advice.
