Only 4,000 of Kenya’s 14,000 NGOs Have Completed PBO Transition

About 4,000 of Kenya’s roughly 14,000 registered NGOs have completed the switch to Public Benefit Organisation (PBO) status, months after the government’s extended deadline for the transition lapsed on May 13, according to figures from the Public Benefit Organisations Regulatory Authority (PBORA).

PBORA has moved into an enforcement phase for the organisations that missed the cutoff. Under the PBO Act, an organisation that receives a default notice from the Authority and fails to submit the required registration documents within 30 days loses its legal status as a registered public benefit organisation.

The PBO Act was first passed in 2013 but did not come into full force until 2024, replacing the older NGO Coordination Act. The government initially set May 13, 2025 as the compliance deadline, then extended it by a year in a gazette notice, pushing the cutoff to May 13, 2026.

Losing PBO status carries direct consequences for an organisation: it forfeits the tax exemptions, banking access, and legal standing tied to registration. The Interior Ministry has directed affected NGOs to re-register under the new framework or risk deregistration.

The transition touches every part of Kenya’s civil society sector, health providers, education charities, environmental groups and human rights organisations among them. Anyone checking whether a specific NGO is currently in good standing can look it up through The NGO Portal’s Nairobi listings, which tracks organisations by sector and county.

Kenya’s PBO transition follows a broader continental push to formalise how development financing and civil society work are governed. The Global NGO Stakeholders Summit has covered the regulations in detail for organisations navigating the switch.
