The Independent Electoral and Boundaries Commission (IEBC) has suspended the Migwani Ward by-election in Mwingi West, Kitui County, after the High Court issued interim conservatory orders on October 22, 2026. The poll had been scheduled for November 17. The court has suspended it for 30 days, and the petition is set for hearing on November 11.
IEBC announced the suspension in a notice on Tuesday, October 27. It said an update “will be communicated at a later date” because the matter is still before the court.
Why was the Migwani by-election suspended?
The orders came in a petition filed at the High Court in Kitui by Francis Musili Kauta, described by Kenyans.co.ke as a civil society activist and politician eyeing the Kitui governor’s seat in 2027. The Star reports the case as Constitutional Petition E011 of 2026, filed against IEBC and three others.
Kauta questions how the ward seat fell vacant. The previous Migwani MCA, Harrison Maluki Mawia, resigned after the Kitui County Assembly appointed him its Chief Clerk. The Star reports the seat fell vacant on August 6.
What did the court decide?
According to Kenyans.co.ke, Justice Riechi ruled that the High Court has no jurisdiction over Mawia’s appointment as clerk, which falls within the Employment and Labour Relations Court. The court did say it can determine the validity of the declaration of the vacancy in Migwani Ward. It issued interim orders so the petition can be heard in full.

What happens to the November 17 poll?
For now, nothing is scheduled. Because the 30-day suspension runs from the court’s orders and the hearing falls on November 11, the November 17 date cannot hold unless the court lifts the orders earlier. Neither report gives an exact end date for the suspension, and IEBC has not published a new polling date. Any new date would have to come from IEBC after the court rules.
The Star reports that the contest had been shaping up as a face-off between Wiper and the UDA. Neither source names candidates, and the case itself is about how the seat became vacant, not about any party.
The suspension adds to a busy run-up to 2027 for the commission. See our earlier reports on the IEBC livestream bill and the suspended KIEMS tender.
